Joint Chambers Luncheon “The Tricks and Traps of Dispute Resolution in China”

In the last couple of years, the increase of foreign direct investment in China has resulted in greater cooperation between Chinese and European entities. However, once the contract is signed, the parties have very different expectations as to fulfilment of their respective contractual obligations, which lead to disputes. To better understand your options when disputes arise, this seminar will touch upon:

• The differences between litigation and arbitration
• The meaning of arbitration in China – Are global companies at a disadvantage? What to be wary of?
• The main changes of CIETAC’s (China International Economic and Trade Arbitration Commission) new arbitration rules in May 2012
• The 2012 amendments to the Civil Procedure Law and their effect on arbitration
• CIETAC’s dispute with its sub-commissions – recommendations as to choice of institution
• The way to get the arbitration you want in China
• Case studies
